Terms of use

Key terms used in these Terms of Use include:Platform, User, Account, Company, Housing provider, Employee, Property, Placement, Services and Content.

These terms define the conditions under which any User may access and use the Platform. Companies and Housing Providers are also subject to additional service agreements.

Users expressly accept these Terms of Use when creating their Account by ticking the dedicated box. TOPPLA reserves the right to amend these terms at any time; Users are notified of any changes.

The Platform is accessible 24 hours a day, 7 days a week at www.toppla.fr, subject to maintenance operations. TOPPLA is subject to an obligation of reasonable efforts, not an obligation to achieve a particular result.

Users must provide accurate, up-to-date information. Only one Account per person is permitted. Users must keep their password confidential and immediately report any unauthorised access.

Modules include:Match (matching), Marketplace (listings), Tools (simulators), Visibility, Connect and Management. TOPPLA acts as a technical intermediary and does not carry out real estate agency activities.

Users undertake to use the Platform in good faith and in compliance with applicable laws, provide accurate information, respect intellectual property rights, refrain from attempting to access the Platform through unauthorised means and refrain from bypassing the Platform to enter into contracts directly with other Users.

TOPPLA is subject to an obligation of reasonable efforts. In particular, it cannot be held liable for User-generated content, property quality, direct contracts between Users, indirect losses or interruptions to access. In all cases, TOPPLA’s liability is limited to the amounts actually paid during the three months preceding the event giving rise to the loss.

TOPPLA retains exclusive ownership of all elements comprising the Platform. Users receive a personal, non-exclusive and non-transferable right of use. Users grant TOPPLA a free, worldwide licence to the Content they publish, solely for operating and promoting the Platform.

TOPPLA processes personal data in compliance with the GDPR and French law. Data is processed to manage accounts, provide Services, connect Users, communicate and comply with legal obligations. It may be shared with technical partners (Stripe, Supabase, Vercel) and relevant other Users. Users have rights of access, rectification, erasure, portability and objection. The Platform uses functional and audience measurement cookies. Users may accept, reject or customise their use through the consent banner.

TOPPLA accepts no responsibility for third-party website content. Any external link to the Platform requires prior written authorisation.

Users authorise TOPPLA to reproduce and distribute the photographs they publish to promote the Platform, throughout their subscription and for five (5) years after the subscription ends.

Users may request deletion of their Account by emailing contact@toppla.fr. TOPPLA may suspend or delete an Account in the event of a breach of these Terms of Use, inaccurate information, fraud, harmful behaviour or inactivity exceeding 24 months.

Stripe manages all financial flows. TOPPLA acts as a technical intermediary. Users are responsible for keeping their payment information up to date.

TOPPLA is released from performing its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code.

If any provision of these terms is found to be void, it will be deemed unwritten without affecting the validity of the remaining provisions. TOPPLA’s failure to enforce a provision does not constitute a waiver of that provision.

These Terms of Use are governed by French law. In the event of a dispute, an amicable resolution will be sought for 30 days. For business users, the Saint-Nazaire Commercial Court has exclusive jurisdiction. For consumers, jurisdiction is determined by the French Consumer Code.
